The Provision and Use of Work Equipment Regulations 1998 (PUWER) place legal responsibilities on those who own, operate, or have control over work equipment. This includes employers and organisations whose staff use equipment.

- Appropriate for their intended purpose
- Safe to operate and maintained in a condition that ensures continued safety

- Operated only by individuals who have received the correct training, instruction, and information
- Equipped with necessary safety features such as guards, emergency stops, isolation switches, and clear warning systems

A PUWER inspection is essential for confirming that machinery can be operated, adjusted, and maintained safely, and that any defects or wear can be identified and corrected before they present a risk.
When Are PUWER Inspections Required?
Employers must ensure that:
- Work equipment is inspected after installation and prior to first-time use, especially when the installation may impact safety.
- Equipment exposed to conditions likely to cause deterioration is inspected at suitable intervals or after significant changes in circumstances (e.g., relocation, modification, or incident).
- Inspection records are maintained until the subsequent inspection takes place.
- Any equipment leaving their control includes documentation showing that the latest required inspection has been completed.
We advise conducting PUWER inspections following major modifications, before recommissioning, and periodically—typically every 12 to 36 months—depending on the environment and associated risks.
